Osusumeya Co., Ltd. and PHOTOPRI Co., Ltd. joint project "Giving young creators a chance to shine!" Application terms and conditions

1. All applicants to the joint project between Osusumeya Inc. and PHOTOPRI Inc., "Giving young creators a chance to shine!", will be deemed to have agreed to these "Application Terms and Conditions."
If the Organizing Committee determines that an applicant has violated the Application Terms and Conditions, the applicant's entry will not be considered for judging. If an applicant has violated the Application Terms and Conditions, or if the Organizing Committee deems it necessary to do so for any other reason, the acceptance of the applicant's entry may be cancelled without the applicant's consent, and the applicant may be removed from the application list, etc.

2. The joint project between Osusumeya Inc. and PHOTOPRI Inc., "Giving young creators a chance to shine!" (hereinafter referred to as "this project") is open to anyone, whether individuals or groups, in principle. However, the following people are ineligible to apply:
① Anyone over 30 years of age at the time of completing their application ② A member of a criminal organization ③ Anyone who has been a member of a criminal organization within the last five years ④ A quasi-member of a criminal organization ⑤ A company related to a criminal organization ⑥ Corporate racketeers, etc. ⑦ Scammers claiming to be involved in social movements, etc. ⑧ Scammers claiming to be involved in political movements, etc. ⑨ A violent group with special intelligence ⑩ Anyone else who falls under any of the above categoriesIf you are under 18 years of age at the time of application, please apply with parental consent to the contents of this project and these terms and conditions.
If you are applying as a group, all members must agree to these terms and conditions before applying.

3. Works that were published before the start of this project can also be submitted to this project.
Additionally, works that have been published elsewhere during the duration of this project can also be submitted.
However, if you submit work that has already been published to this project, you will be solely responsible for any problems that arise.

4. There is no specific limit to the number of submissions to this project. Individuals may submit multiple works. However, duplicate submissions of the same work are not permitted.

5. If you are reusing a publicly available dataset or other copyrighted work, you must fill in the application form with the subject of the reuse (dataset, copyrighted work, etc., hereafter collectively referred to as information resources) and, if it is publicly available online, please include its URL. The same applies if the reuse involves processing or modification.

However, there is no need to include ideas or words that are widely reused, such as those that many people have in mind.

6. If information about the information resources to be reused is not entered in the application form, the Administrative Office may determine that reuse has occurred without the applicant's consent. In addition, even if information about the subject of reuse is entered, the Administrative Office may determine, without the applicant's consent, that there are information resources reused other than those entered. (This will not immediately result in disqualification.)

7. You may freely add to, change, or modify any works or creations submitted to this project from the entry period through September 29, 2024. Application content will be reviewed as of the day after the submission deadline. Any additions, changes, or modifications made after that date will not be reviewed.
If you wish to withdraw your entry after submitting it, please contact the Organisers via email to notify them of your withdrawal.

8. Any claims or disputes arising from the designation of copyright, the reuse of a dataset with designated copyright, or the use of a dataset published elsewhere on this site must be handled by the applicant themselves, and the Organizing Committee will not be held responsible in any way.

9. If the entrant wishes to use (including re-use) any copyrighted material owned by a third party, the entrant must obtain prior permission before submitting the entry. Any complaints or disputes that arise in the event of the use of copyrighted material owned by a third party must be handled by the entrant himself/herself, and the Organizing Committee will not bear any responsibility whatsoever.

10. Applicants warrant that they hold the necessary intellectual property rights and other legitimate rights to apply for or provide licenses to this Project with respect to any inventions, concepts, information, works, trademarks, know-how, ideas, etc. contained in or based on the dataset they are submitting, or that they have properly cleared such rights, and that the reuse of the submitted dataset in connection with this Project by other applicants or the Organiser will not infringe the rights of the applicants or any third parties. Applicants shall indemnify the Organiser for all damages incurred by them as a result of their breach of such warranty.
However, if you reuse a dataset or other material provided under a public license by a third party other than the applicant, and you properly inform the Organizing Committee of that reuse and license through the application form, the Organizing Committee will handle the data in accordance with that information in a manner that does not infringe on the rights of third parties.

11. Applicants agree that the Organiser may use the submitted work free of charge (including publishing it in various media, displaying it in the relevant store, and adapting it in any way, such as by extracting, summarising or modifying only a portion of it).
Furthermore, applicants shall not exercise their moral rights regarding such use. Applicants also agree in advance that the submitted dataset will be widely published to third parties, and shall determine the scope and content of the information contained in the submitted dataset at their own responsibility. Applicants agree in advance that the Organizing Committee shall not bear any responsibility for any damages incurred by applicants as a result of the use or publication of the submitted dataset in this project.
However, if you reuse a dataset or other material provided under a public license, and you have properly notified the Administrative Office of that reuse and license through the application form, the Administrative Office will handle the data in accordance with that information in a manner that does not infringe on the rights of third parties.

12. Applicants must not include in their submitted work any intellectual property rights, confidential information, etc. that they do not wish to be disclosed to third parties, and must take appropriate procedures for protecting rights in advance, to the extent necessary, at their own responsibility and discretion for any information included in the submitted work.

13. Applicants shall not include any confidential information in their submitted work, and in the unlikely event that the submitted work does contain confidential information, applicants shall acknowledge in advance that such confidential information may be made public and shall not claim any damages from the Organiser.

14. Any disputes arising from or related to these regulations and this project shall be interpreted and resolved in accordance with Japanese law. Even if any part of these regulations is deemed invalid, the remaining provisions shall remain valid. These terms and conditions may be amended if the Management Office deems it necessary. For matters not specified in these regulations or matters that raise doubts, you must follow the decisions made by the Management Office, so please check the latest information.

15. To the maximum extent permitted by law, in the event of any dispute or action arising out of or in connection with this Contest, any other right of the Applicant to bring a lawsuit, seek injunctive relief, or file a judicial or other proceeding against the Organiser is hereby excluded, and the Applicant expressly waives all such rights. In addition, the Tokyo District Court shall be the exclusive court of first instance with respect to any dispute arising out of or in connection with this Contest.

16. The Organiser shall not be liable for any loss, damage, expenses incurred in connection with the holding of this Project, and shall not be liable for any entrants or any technical problems arising from such entrants.

17. The Organiser is not responsible for any theft, plagiarism, destruction, unauthorised access to or alteration of submitted Works, or for any technical, network, telephone, computer, hardware or software malfunctions or limitations.
Additionally, the Administration is not responsible for any omission, interruption, deletion, defect, or delay in operation or transmission due to electronic transmission errors.
The Organizing Committee shall not be liable for any economic or other losses incurred in connection with applying for this project or during the application period.

18. The Organisers shall not be liable for any damages incurred by applicants arising from or in connection with their submission to this Project in relation to intellectual property rights, confidential information, etc. contained in the submitted work.
If an entrant receives a demand or complaint from a third party arising from or in connection with the submitted work, or if a demand or complaint is made against a third party, the entrant shall handle and resolve such demands, complaints, and any disputes arising therefrom at his/her own responsibility and expense, and shall not cause any inconvenience or damage to the Organisers.
The Organiser shall not bear any responsibility for such trouble. In the unlikely event that the Organiser suffers damage as a result, the applicant shall compensate the Organiser for all damage, loss and expenses incurred by the Organiser through his/her own actions.

19. The Organisers may request personal information such as name and contact details from applicants and those who apply to participate in the event through the application process and surveys after participation.
This personal information will be managed strictly and used for the purposes of running the event, publishing in various media, displaying in the relevant stores (including use that involves adaptation such as extracting, summarizing, and processing only a portion of the information), and creating explanatory materials. The information will be used for the operation of the project , publication in various media, and display at the relevant stores , and may include the contents of the submitted entries, presentations, and other comments, but names, contact information, and specific names of affiliations will not be published without permission. However, names, etc. may be included when publishing reports and explanatory materials about the contest on websites, etc. In such cases, permission will be obtained from the entrants before publication.
